Why do you need all of these tools and protections?  Complying with the requirements of the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) are simply not an option.  Most businesses, including yours, have in place rules and protections regarding your relationship with your employees, such as an employee handbook and policies and the like. Why then, would you ignore an essential component of such a relationship and fail to provide policies and rules regarding the use and disclosure of protected health information (“PHI”) under HIPAA?

All Employer sponsors of Group Health Plans, regardless of whether they are self-funded or fully insured must ensure that there is the appropriate protection in place to comply with these requirements and avoid exposure and potential substantial liability.

FAQs - HIPAA Compliance

Do we really have to comply with HIPAA?

Yes. Your group health plan, whether it is insured or self-insured, will have access to protected health information in some form and in some manner, whether it is information that flows from the underwriting and process of bidding and obtaining coverage, or claims or appeals, or just from an employee seeking assistance in getting claims paid or with coverage questions.

What happens if I do not have a HIPAA policy?

There are numerous instances where the lack of a policy can create substantial liability to you or your business. From government audits and investigations, which are continuing, to employee claims and plaintiff’s lawyers, without the protections of a policy, you are open to claims and liabilities. Just because it hasn’t hit you yet, does not mean it won’t.  Be prepared with a great Warranty, at an affordable cost.
