Why do I need a plan document?

Almost every employer requires employee contributions toward some form of health and welfare benefit. Whether it is just premium pre-tax payments, or a full flexible spending account and dependent care assistance account or health savings account, you need a written document to govern the program. There are many reasons for this. First, this plan is a type of employee benefit and as such, ERISA Section 402 requires a plan document and ERISA Section 102 requires a summary plan description. Most employers will include the cafeteria plan documentation in the Wrap Plan document and summary plan description.

IRS will also require a written document consistent with Internal Revenue Code Section 125, under which these arrangements operate.

 If I only have pre-tax premium payment benefits, do I still need a document?


If I have flexible spending account plan, dependent care assistance plan or health savings plan options, will the EZ ERISA Plan cafeteria plan document allow me to include these options?
